At B&A Litigation Services, our exhibit binder services are designed to bring organization, consistency, and efficiency to the deposition process. Managing exhibits across multiple depositions can quickly become time-consuming. B&A simplifies this process by organizing, maintaining, and presenting exhibits in a structured, reliable system so attorneys can focus on testimony, not logistics.

Our exhibit binder services ensure that exhibits are always accessible, clearly labeled, and consistently numbered throughout the life of a case. Ask for it and this is part of our deposition case management: complimentary, case-wide, and not charged for. We offer it at the first deposition in a case, so the easiest time to say yes is at the start.

What the Exhibit Index Does

The exhibit index is the running list of every exhibit marked in the case. It is how anyone on the case, months later, finds which document was shown to which witness. It travels with the exhibit binder, and for each exhibit it gives:

  • The exhibit number
  • The witness name
  • The date of the deposition
  • The volume number

The index ties to the transcript through the number itself. The court reporter records each exhibit as it is marked, and the number in the index is the same number spoken on the record and printed in the transcript. Search the transcript for the number and you are at the testimony about that document.

Numbering runs consecutively across depositions, not per witness. If the first deposition ends at Exhibit 14, the second deposition starts at Exhibit 15. And a document that has already been marked keeps its original number when it comes back with a later witness, so Exhibit 37 is Exhibit 37 for every witness who sees it. We track the sequence for you, so nobody in the room has to ask which number they are on.

We also hold the original exhibits until trial, at no charge.

Consistent and Consecutive Numbering

One of the most valuable aspects of B&A’s exhibit binder services is consistent, consecutive exhibit numbering across depositions, which we provide when you request it. Rather than restarting numbering for each witness or risking duplication and confusion, B&A tracks exhibits throughout the case to maintain continuity. This approach reduces confusion during testimony, improves transcript clarity, simplifies cross-referencing between depositions, and supports smoother trial preparation. Attorneys can rely on exhibits being identified consistently from one deposition to the next.

Centralized Exhibit Organization

In cases involving multiple witnesses or repeated depositions, exhibit management is critical. B&A maintains a centralized set of exhibits that can be used across depositions, ensuring that attorneys always have access to the correct materials at the right time.

Exhibits can be maintained in physical binders, digital binders on iPads or other devices, or a combination of both, depending on attorney preference. This flexibility allows counsel to choose the format that best supports their workflow while maintaining a single, organized source of truth.

Exhibits Online Through the Client Portal

In addition to physical and digital binders, B&A gives clients access to exhibits through our secure client portal. Your team can upload exhibits ahead of a deposition, and those uploads feed the binders and, where you have asked for it, the case-wide numbering.

Everyone on the team works from the same current exhibit set, with fewer duplication and version-control issues.

Always Ready for Each Deposition

When B&A manages exhibit binders, exhibits are prepared in advance and ready for use at every deposition. Whether proceedings are in person, remote, or hybrid, attorneys have immediate access to organized exhibits via binders, iPads, or the client portal without scrambling for documents or reassembling materials each time.

For digital exhibit binders, materials are easy to navigate and display during questioning. Physical binders are clearly tabbed and labeled for efficient use. For remote and hybrid depositions, a B&A exhibit technician can share and display exhibits on screen; see exhibit handling and screen sharing.

Coordinated With the Court Reporter

Because exhibit binder services are integrated with B&A’s court reporting operations, exhibits are properly marked, referenced, and reflected accurately in the transcript. The result is a transcript with clean exhibit references that is easy to use for later review or motion practice, and, when ordered, ready for hyperlinked exhibits that open each document from the testimony.

This matters most in multi-party and expert-heavy cases.

Frequently asked questions

An exhibit index is the numbered list of every exhibit marked in a case or deposition. For depositions, it lets anyone find which document was shown to which witness. On a B&A case, the index travels with the exhibit binder and gives each exhibit’s number, the witness name, the date of the deposition and the volume number, and those numbers match the ones spoken on the record and printed in the transcript.

Consecutive numbering means exhibit numbers continue across every deposition in the case instead of restarting at 1 for each witness. If one deposition ends at Exhibit 14, the next starts at 15. Ask us to run it case-wide and B&A tracks the sequence for you, so there are no duplicate numbers and nobody in the room has to ask which number they are on.

No. It keeps the number it was given the first time. That is the point of numbering a case consecutively: a document is one number for the whole case, however many witnesses see it. When you later compare what three witnesses said about Exhibit 37, you are searching one number across every transcript instead of reconciling three.

“Exhibit 1” is the first document marked for identification in the proceeding, or in a case numbered consecutively, the first exhibit of the case. The court reporter records the number as the document is marked, so every later reference to “Exhibit 1” in any transcript points back to the same document.

No. Case-wide exhibit management is complimentary. It is not switched on automatically, so tell us you want it and we set it up; on a first deposition in a case we will offer it. It includes tracking and sequential indexing across every deposition and holding the original exhibits until trial. Every charge appears as its own line item on the invoice. The fees we do charge are intentional, and none of them are hidden.
