At B&A Litigation Services, we provide professional Independent Medical Examination (IME) videography services to accurately and neutrally document IMEs for litigation and insurance-related matters. IMEs often play a critical role in personal injury, workers’ compensation, medical malpractice, and disability cases, making reliable documentation essential.
B&A’s IME videography services are designed to preserve what occurs during the examination in a clear, factual, and litigation-ready format without interpretation, commentary, or interference.
Our videographers do not direct, influence, or participate in the examination. They are part of the same legal videography team that records our depositions, and they hold to the same standard: record what happens and nothing else.

Purpose of IME Videography
An IME can be a pivotal moment in a case. Videography provides an objective visual record of the examination, capturing interactions, instructions, physical movements, and testing as they occur. This documentation can be valuable for later review by attorneys, experts, insurers, or courts particularly when the scope, conduct, or conclusions of the examination are later questioned.
IME videography helps ensure transparency and accountability while preserving the examination exactly as it took place.
What IME Videography Can Capture
B&A’s videographers document IMEs in a professional, unobtrusive manner, recording elements such as:
- The overall examination environment
- Instructions provided by the examiner
- Physical examinations or testing (as permitted)
- The examinee’s responses and movements
- Timing and flow of the examination
- Interactions relevant to the examination process
The goal is to capture a complete and accurate visual record of what occurs.
Neutral, Professional Videographers
IME videography requires a careful balance of technical skill, professionalism, and discretion. B&A’s videographers are trained specifically for legal environments and understand the sensitivity and importance of IMEs.
They work quietly and efficiently, positioning equipment to capture the examination without disrupting the process. Our videographers maintain strict neutrality at all times and do not offer opinions, analysis, or commentary regarding the examination or findings.
Before the Examination
Recording an examination has to be authorized. Before we film, we confirm with the ordering attorney that the recording is permitted by the court order, a stipulation between the parties, or the rule that applies to the matter, and we note any conditions it sets on who may attend or where the camera may be placed.
B&A provides IME videography services in a range of settings, including medical offices, clinics, and other examination facilities. We coordinate in advance to understand access requirements, facility protocols, and any limitations related to filming, ensuring a smooth and respectful process on the day of the examination.
After the Examination
The recording goes to whoever ordered it. If another party in the matter needs a copy, they contact B&A and we handle the request. Because IME footage contains medical information, it is delivered and stored under the same confidentiality protocols as the rest of our work.
Supporting Litigation and Claims Review
IME videos may be used for a variety of purposes, including:
- Attorney review and case evaluation
- Expert analysis
- Insurance claim review
- Dispute resolution or litigation support
By preserving the examination visually, IME videography provides an additional layer of documentation that can support clarity and reduce disputes over what occurred during the examination.
Confidentiality and Professional Standards
IME videography often involves sensitive medical information and personal interactions. B&A adheres to strict confidentiality and data-handling protocols to protect privacy and ensure all recordings are managed securely.
Our videographers follow professional standards designed to preserve the integrity of the examination and the trust of all parties involved.
Frequently asked questions
What is an IME in a lawsuit?
An independent medical examination is an examination of a party whose physical or mental condition is at issue, performed by a physician or other examiner, usually requested by the opposing side. In litigation it is often arranged under a court order or by agreement of the parties. Video records how the examination was conducted, not whether its conclusions are right.
Can an IME be video recorded?
Washington’s Civil Rule 35(a)(3) provides: “Unless otherwise ordered by the court, the party being examined or that party’s representative may make an audiotape recording of the examination, which shall be made in an unobtrusive manner. A videotape recording of the examination may be made on agreement of the parties or by order of the court.” Workers’ compensation examinations are arranged differently; ask the attorney handling the claim.
We quote the rule; we do not interpret it. What it means for your examination, and whether recording should be requested at all, is a question for the attorney. What we can tell you is our side of it: B&A follows what has been agreed or ordered. Before the examination we confirm the agreement or order with the ordering attorney, film within whatever conditions it sets, and deliver the recording to whoever ordered it. We do not advise on whether recording should be requested.
The rule itself: Washington CR 35
Does the videographer take part in the examination?
No. The videographer sets up the camera and microphone, records the examination from start to finish, and stays out of it. They do not speak to the examiner or the examinee about the examination, do not direct anything that happens, and do not offer opinions afterward about the examination or its findings.
Who receives the recording?
Whoever ordered it. The recording is delivered to the party who booked the videography. If anyone else in the matter needs a copy, they contact B&A and we handle the request. Because IME footage contains medical information, it is handled and delivered under the same confidentiality protocols as the rest of our work.
